Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period: the period within which the consumer can exercise their right of withdrawal;
  • Consumer: the natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur;
  • Day: calendar day;
  • Long-term transaction: a distance contract relating to a series of products and/or services, for which the supply and/or purchase obligation is spread over time;
  • Durable data carrier: any means that enables the consumer or entrepreneur to store information that is personally addressed to them in a way that allows future consultation and unaltered reproduction of the stored information;
  • Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period;
  • Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance;
  • Distance contract: an agreement concluded between the entrepreneur and the consumer within the framework of a system organized by the entrepreneur for the distance sale of products and/or services, whereby, up to and including the moment the agreement is concluded, exclusive use is made of one or more means of distance communication;
  • Means of distance communication: a method that can be used to conclude an agreement, without the consumer and entrepreneur being together in the same place at the same time;
  • General Terms and Conditions: these General Terms and Conditions of the entrepreneur.

Article 3 – Applicability

  1. These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
  2. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions are available for inspection at the entrepreneur's premises and will be sent to the consumer free of charge as soon as possible upon request.
  3. If the distance contract is concluded electronically, the text of these general terms and conditions may be made available electronically in such a way that the consumer can easily store it on a durable data carrier before the contract is concluded.
  4. If one or more provisions of these general terms and conditions are at any time wholly or partially null and void or annulled, the agreement and these terms and conditions will remain in force for the rest. The relevant provision will be replaced by mutual agreement as soon as possible by a provision that approximates the original intent as closely as possible.
  5. Ambiguities regarding the interpretation or content of one or more provisions of these general terms and conditions should be interpreted ‘in the spirit’ of these general terms and conditions.

Article 4 – The Offer

  1. If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.
  2. The offer is non-binding. The entrepreneur is entitled to modify and adapt the offer.
  3. The offer contains a complete and accurate description of the products and/or services offered. If the entrepreneur uses images, these will be a true representation of the products and/or services. Obvious errors or mistakes in the offer are not binding.
  4. The price of the product is excluding clearance costs and import VAT. These additional costs will be borne by the customer. The postal and/or courier service will collect the VAT (together with any clearance costs) from the recipient of the goods.
  5. Each offer contains such information that it is clear to the consumer what rights and obligations are attached to the acceptance of the offer.

Article 5 – The Agreement

  1. The agreement is concluded when the consumer accepts the offer and fulfills the conditions set therein.
  2. If the consumer has accepted the offer electronically, the entrepreneur will confirm receipt of acceptance. As long as this confirmation has not been received, the consumer can dissolve the agreement.
  3. The entrepreneur will take appropriate technical and organizational measures to secure the electronic transfer of data and will ensure a secure web environment.
  4. The entrepreneur can, within legal frameworks, ascertain whether the consumer can meet their payment obligations and other relevant factors before concluding the contract. If the entrepreneur has good reasons not to enter into the agreement, they are entitled to refuse an order or attach special conditions.
  5. The entrepreneur will provide the consumer with the following information:
    • The visiting address of the company where complaints can be lodged;
    • The conditions and manner in which the right of withdrawal can be exercised;
    • Information about guarantees and existing after-sales services;
    • The requirements for terminating the agreement if it has a duration of more than one year.
  6. Each agreement is entered into under the suspensive condition of sufficient availability of the relevant products.

For international orders, the customer is responsible for paying any applicable customs duties, taxes, and VAT upon receipt of the goods.
